Depuis 2016, les grandes installations g\u00e9othermiques \u00e0 fabile profondeur en Thurgovie tombent sous le coup de la Loi sur l\u2019utilisation du sous-sol, ce qui renforce les prescriptions et les charges en mati\u00e8re d\u2019autorisation.\u00a0<\/strong> Le 28 novembre 2018, l\u2019Office de l\u2019environnement et le D\u00e9partement de l\u2019\u00e9nergie ont invit\u00e9 \u00e0 participer \u00e0 un \u00e9change d\u2019exp\u00e9riences. Le but \u00e9tait de remanier de mani\u00e8re pragmatique les prescriptions actuelles en mati\u00e8re d\u2019autorisation au vu des exp\u00e9riences acquises et, par l\u00e0, de cr\u00e9er pour toutes les parties prenantes, une proc\u00e9dure d\u2019autorisation aussi efficace que possible pour des champs de sondes g\u00e9othermiques.<\/strong><\/p>\n

Dans le canton de Thurgovie, la Loi sur l\u2019utilisation du sous-sol est en vigueur depuis avril 2016. Elle ne concerne pas uniquement toutes les utilisations g\u00e9othermiques profondes, soit \u00e0 plus de 500 m de profondeur, mais aussi toutes les utilisations \u00e0 fabile profondeur avec une puissance de soustraction de chaleur de plus de 100 kW.<\/p>\n

Autorisation selon la l\u00e9gislation sur la protection des eaux et\/ou la Loi sur l\u2019utilisation du sous-sol
\n<\/strong>L\u2019autorisation classique selon la l\u00e9gislation sur la protection des eaux (LEaux) requiert une autorisation pour un forage et un permis de construire pour les constructions et les installations. Selon la nouvelle Loi sur l\u2019utilisation du sous-sol, une autorisation cantonale est n\u00e9cessaire pour l\u2019utilisation thermique \u00e0 partir d\u2019une puissance de 100 kW ou des forages \u00e0 plus de 500 m de profondeur, ce qui englobe l\u2019autorisation pour le forage et le permis de construire selon LEaux. Une concession est m\u00eame prescrite \u00e0 partir d\u2019une puissance d\u2019extraction de 1’000 kW.<\/p>\n

La Loi sur l\u2019utilisation du sous-sol d\u00e9finit les exigences li\u00e9es \u00e0 l\u2019autorisation de grands champs de sondes g\u00e9othermiques. Depuis 2016, l\u2019Office de l\u2019environnement a pu collecter de premi\u00e8res exp\u00e9riences en sa qualit\u00e9 d\u2019autorit\u00e9 d\u2019octroi d\u2019autorisations<\/p>\n

Cr\u00e9er une proc\u00e9dure d\u2019octroi d\u2019autorisations aussi efficace que possible
\n<\/strong>Une collaboration avec le D\u00e9partement de l\u2019\u00e9nergie a men\u00e9 l\u2019Office de l\u2019environnement \u00e0 un \u00e9change d\u2019exp\u00e9riences avec des membres des autorit\u00e9s communales et des sp\u00e9cialistes en \u00e9nergie du canton de Thurgovie. Les repr\u00e9sentants des autorit\u00e9s ont rendu compte des exp\u00e9riences acquises jusqu\u2019ici et expliqu\u00e9 les diff\u00e9rentes phases de la nouvelle proc\u00e9dure d\u2019octroi d\u2019autorisations selon la Loi sur l\u2019utilisation du sous-sol. Des exemples concrets ont montr\u00e9 quels documents sont requis pour le dossier de demande d\u2019autorisation ainsi que quand, quoi et par qui des clarifications doivent \u00eatre r\u00e9alis\u00e9es, afin de garantir une proc\u00e9dure d\u2019octroi d\u2019autorisations aussi efficace que possible.<\/p>\n

Ax\u00e9e sur la g\u00e9othermie profonde et non sur des champs de sondes g\u00e9othermiques
\n<\/strong>Nombre de participants et participantes ont r\u00e9pondu \u00e0 l\u2019invitation et discut\u00e9, apr\u00e8s les expos\u00e9s, des arguments pour et contre la nouvelle pratique en mati\u00e8re d\u2019octroi d\u2019autorisations. Par principe, tant les participants et participantes que les membres des autorit\u00e9s s\u2019accordaient \u00e0 dire que les conditions pr\u00e9alables et les charges renforc\u00e9es pour l\u2019octroi d\u2019autorisations ont engendr\u00e9 de nouvelles entraves \u00e0 la r\u00e9alisation de champs de sondes g\u00e9othermiques. Les exp\u00e9riences acquises au cours des deux derni\u00e8res ann\u00e9es ont montr\u00e9 que l\u2019actuelle Loi sur l\u2019utilisation du sous-sol \u00e9tait n\u00e9e dans la perspective de projets de g\u00e9othermie profonde et au vu des \u00e9v\u00e9nements de Saint-Gall, et n\u2019\u00e9tait pas sp\u00e9cialement ax\u00e9e sur la g\u00e9othermie \u00e0 faible profondeur.<\/p>\n

C\u2019est ainsi, par exemple, qu\u2019en dehors de la responsabilit\u00e9 civile obligatoire pour le ma\u00eetre d\u2019ouvrage durant la phase de construction, il faut aussi pr\u00e9senter une attestation d\u2019assurance (responsabilit\u00e9 civile) pour toute la dur\u00e9e de l\u2019autorisation. Les demandes doivent \u00eatre mises en plus en d\u00e9p\u00f4t public au moins huit semaines, ce qui engendre du retard pour l\u2019ensemble du projet de construction. Tous les cinq ans, il faut en outre v\u00e9rifier si une installation n\u2019a pas de r\u00e9percussions sur le voisinage. Ce qui est difficile \u00e0 justifier juridiquement est le passage d\u2019apr\u00e8s lequel l\u2019autorisation selon la Loi sur l\u2019utilisation du sous-sol se r\u00e9f\u00e8re aussi aux b\u00e2timents. Par ailleurs, la limitation de l\u2019autorisation \u00e0 25\u00a0ans est en contradiction avec la conception m\u00eame d\u2019installations g\u00e9othermiques pour une p\u00e9riode de 50 ans selon la norme SIA. Ici, les repr\u00e9sentants des autorit\u00e9s ont d\u00e9crit la difficult\u00e9 de faire la distinction entre un grand champs de sondes g\u00e9othermiques, soumis \u00e0 autorisation selon la stricte Loi sur l\u2019utilisation du sous-sol, et plusieurs installations plus petites inf\u00e9rieures \u00e0 100 kW (autorisation selon LEaux), si ces derni\u00e8res empi\u00e8tent sur des parcelles voisines et appartiennent \u00e0 un ma\u00eetre d\u2019ouvrage.<\/p>\n

Optimisation vis\u00e9e de la proc\u00e9dure d\u2019octroi d\u2019autorisations
\n<\/strong>Les autorit\u00e9s thurgoviennes d\u2019octroi d\u2019autorisations veulent adapter aussi rapidement que possible la proc\u00e9dure d\u2019octroi d\u2019autorisations pour des champs de sondes g\u00e9othermiques au vu des exp\u00e9riences acquises et des retours d\u2019informations re\u00e7us de la part des participants et participantes \u00e0 l\u2019\u00e9change d\u2019exp\u00e9riences. De possibles modifications, tels que cit\u00e9es lors de la manifestation, sont l\u2019adaptation de la dur\u00e9e d\u2019autorisation de 25 \u00e0 50 ans, des adaptations de la preuve obligatoire d\u2019une assurance responsabilit\u00e9 civile, et cas \u00e9ch\u00e9ant, un rel\u00e8vement de la valeur seuil pour la puissance d\u2019extraction, voire m\u00eame la suppression de la g\u00e9othermie \u00e0 faible profondeur de la Loi sur l\u2019utilisation du sous-sol. Les autorit\u00e9s d\u2019octroi d\u2019autorisations vont discuter des diverses possibilit\u00e9s en consultant des experts et proposer des amendements correspondants de la loi au Gouvernement cantonal. Le but des autorit\u00e9s est d\u2019obtenir une proc\u00e9dure d\u2019octroi d\u2019autorisations aussi efficace que possible pour toutes les parties prenantes.<\/p>\n
